IPDF, I "believe" the Court's intent was to have the settlement conference take place with the magistrate by December 1st, but his Order is subject to interpretation. I don't think anyone can make a 100% definitive response to your question.

"If the parties are unable to come to an agreement, the Court FURTHER ORDERS the parties to schedule a settlement conference with the United States Magistrate Judge assigned to this case no later than December 1, 2013."
