That lawsuit being dismissed due to a lack of jurisdiction, meaning without prejudice, so it can be filed again in the proper court , furthermore im pretty sure the SEC can investigate any stock traded in the US so jurisdiction is not an issue, but realistically i don't believe the SEC wastes much time on penny stocks
