40. Because of 350 Green’s failure to perform under the APA since April 30, 2013,
JNS has been damaged insofar as JNS has incurred additional operational costs and expenses,
including attorney’s fees and costs incurred both before and after the entry of the Court’s
September 24, 2013 order, and will incur additional costs in terms of overtime wages that will be
required to timely complete the network under the terms of the Chicago Grant because of 350
Green’s failure, refusal and delay in performing under the APA.
