Its not a stretch at all. It is fact. We are talking about a utility patent which is structural. Its not like making a cosmetic change on something and applying for a patent on a square donut as opposed to a round one. This technology is akin to the first radio communications patents. For nearly a century there was one way to do it. You couldn't just change the shape of the vacuum tubes and get a separate patent.
