Why did their lawyers not explain this in the hearing? or did they try and were ineffective at communicating it?

Sorry, if I am following, what this would suggest is ATVI's MSJ request is absurd....not sure how the law interprets it but I would think the 'spirit of the law' would suggest similar.

Again, question, was this expressed in the hearing and just poorly? and if so am I right in assuming the MSJ should ultimately be denied?
