While I understand your theory it is not accurate.

Worlds did not include the specific reference to the provisional application that was required at the time (section 1.78). Although it was included in data sheets (not application data sheets!) and other transmittal it still did not follow rules at the time (interpreting it from the judges standpoint).

This is a very unique case and it would not create chaos. I do believe that the court will meet in the middle and state that infringement will occur after the 8-14-2013 certificate of correction.
