All death spiral convertibles are payable in cash. But they never are. If the company had any cash, they wouldn't need to sell death spirals convertible at a 25-70% discount to market!

By definition, it is. And I think you will begin to see the effects very soon, if you have not already. The stock price has not performed well at all since the prospectus went effective, has it?

And I highly doubt the need for them to continue selling toxic convertibles will ever stop. If the market and industry really thought NBRI had a legitimate chance of producing enough gold to turn a profit, they would have had no problem whatsoever receiving conventional financing. But, they didn't. Thus, the need for the toxic death spirals.
