While I agree that this is their primary goal, ATVI definitely has shown that the secondary goal (or risk mitigation) is to delay as long as possible extending the date with the possibility of worlds having to refile.

If that wasn't the case they would have submitted the MSJ earlier. They waited until the last minute to submit it.
