I read where in International Law they always do them after. But in several districts and headed towards the whole country, we will start doing ALL before. it is a waste of court time to judge something that may have a wrong court date. Thus they are always leaning towards expediting issues.

I don't think they will now do the MSJ later. It is a done deal, nothing to hear. I also think there was no real question as to the dates on the patents as there was little to none questioning that could be done on it. THey were plain and simple dates....

Anyway, I will read up some more. FOund a great page on Markmans when google searching it. I think she gives them a month to prepare. We all knew this news, but WDDD had to get the paper in hand, just because it was posted on the USPO page did not mean much except for the chat here. Once they receive the mail, then then had to make the request and know the judge receive it before putting out a PR. Kind of stupid how things work. But I think it would have ben a mistake on WDDD's part to put out a PR based on the website news, then announce asking for an up-dated to the Markman without asking the judge first.
