I assumed you meant something more on the lines of a small miner exemption for permitting. I see that argument made frequently by scammers that say they don't need to file permits to open a mine in Arizona because they are a "small miner". Perhaps there is some confusion (possibly deliberate) in the maintenance fee thing versus environmental permits.
By the way, the new fee structure with the BLM will go a long ways towards weeding out the scammers, especially those running placer scams like OODH and Bayou. It won't be so cheap anymore to claim and control the mineral rights on large areas of worthless land.
