I'm not a lawyer, and don't know the filing rules, but your explanation of why this is late doesn't make sense to me.
If you "start on the 5th" then you need to count the 5th as Day 1. So let's go thru this slowly now:
Sep 5 = Day 1
Sep 6 = Day 2
Sep 7 = Day 3
Sep 8 = Day 4
Sep 9 = Day 5
Sep 10 = Day 6
Sep 11 = Day 7
