NASDAQ-OMX has no problem with companies who wish to fund their ops or cap-ex with shares. Why the hell else are shares issued in the first place? Under your condition, any company issuing shares would be forbidden to list.
All that they require is to have any O/S increase reported within 24/48 hours as opposed to the SEC, which only require quarterly updates.
Actually, this regulation comes from the Swedish Financial Supervisory Authority. It's not even an OMX rule, it's just OMX ensures that its members are compliant.
