Yes. Perry Capital is in the ring with the US Treasury and FHFA at the same time. US Treasury and FHFA will argue they had the right under HERA to make, sign, and enact the Third Amendment, though I cannot see how that argument can stand without withering under the glaring, heated light that the Perry Capital lawsuit brings to their actions...The suit does not seek monetary compensation. It seeks to vacate the Third Amendment, which will place the GSEs back into the position of private companies under conservatorship and out of the position of being effectively nationalized.
