The Microsoft deal was all about Microsoft and VRNG agreeing that Microsoft was infringing. Having one company say they are infringing makes it a little easier to make a point.

"See, Microsoft already agrees with us."

It's a very small piece to the puzzle. So VRNG makes 5% of whatever the RR from Google going forward is (or whatever the amount turns out to be). The truth is that VRNG and Microsoft wanted to stick it to Google and VRNG isn't really concerned with the small additional amount they could get from Microsoft. Why should VRNG care if they get $20M, $30M, or $40M when they are working on a billion dollar case?

It's all about positioning.

Who cares about Microsoft in the grand scheme of things?
