I believe that the manner in which HJJ is handling this patent case with a claimed work around being made subsequent to the jury verdict will be the textbook way this type of case will be handled in the future throughout all the Federal District Courts. Could he have made some rulings earlier and set the briefing deadline on the RR earlier, yes. However, overall, I think that otherwise, when there is a claimed work around, that you will see other cases being handled in the same manner HJJ is handling this one. Anyone playing a patent play now, or in the future, should be aware that the Court is likely to handle a work around exactly as HJJ is handling this one. If you don't like it, don't get in one for the long haul and just play the pops. He has fully set forth the legal precedent in his order for the manner in which he is handling this case, so he's not the judge that invented the wheel. He's simply following precedent that has already been set in handling the claimed work around. Personally, I don't fault him at all in the way he scheduled the work around part of the case. I also think the timelines are reasonable, and are actually fairly short.

If you don't like the way this case is going along, I'd stay out of patent plays because this will be the norm in those that have a claimed work around that gets claimed after jury verdict. Handling it this way prevents two separate proceedings, and two separate appeals. This way the whole shootin match goes up on appeal in the main case. It's reasonable, judicially economical, and you can bank on seeing it handled this way in other patent cases in which a claimed work around comes out after the verdict. Watch and see.

Red Angus, JJS,and other legal minds, investors are interested in finding out what is going on with HJJ, there should be an inquiry about how this case has been handled. Perhaps the judge in Florida who put Google in its place could help by bringing to light the unfairness in the part of Google and HJJ handling this casd. As investors of VRNG we have a right to protect our investments, we have to be careful in the sense backlash from the pulpit. I am not an attorney, but how can we find out how this has been handled.?
