DELAYED COURT CASE - CAUSED BY DEFENDANTS -

I heard that one of the defendant's legal team had arranged and pre-paid for his own personal holiday this week. When the court announced this week as the time to sit again he approached smme legal team and the court, requesting that court be rescheduled. Not wanting to appear petty, and in the spirit of fairness, smme agreed to the delay.

This is why we have a delay until September. Do not allow yourselves to be convinced that smme is responsible for this delay.

I wonder how the judge will view the commitment of defence counsel. I would have thought that having a seat in the largest ever patent litigation matter before court would perhaps be a little more compelling than a family holiday. Maybe its a good trip that has been booked, and just maybe defence counsel won't be able to afford another one post court results....out of work!?
