The CD owners are always restricted in % of shares that they are allowed to hold in the company stock. Most of the time it is like 5% or less but that really means nothing as all they have to do is have one of their pal funds of group of funds, buy up the stock at the conversion prices to get a big, big chunk of the company without ever owning enough to trigger 10% ownership filings.
There are a million ways to get around that one, like 70 million shares in 5 different accounts give you 350 million shares and no one is any the wiser.
