I am long and still optimistic but to me the one grey here is the Judge. Because no matter what anyone thinks about the workaround, he is the one who is going to decide if there is one. And he is yet to set a date when he is going to decide that or the RR. I hope the discovery requirements force Google to settle but there is no way to know. I would like to know how JJ has ruled on the issue of workarounds in the past.
