Postyle covered the patent question in this post... not going to argue as he has more knowledge in that area... the lack of an 8k is a smoking gun for sure...

Sorry, but a lack of published application or filing was covered a long time ago (see linked post below).

Message #32221 (April 18, 2013):

1) provisional applications are not published

2) non-provisional applications are not published for 18 months unless the applicant requests it be published earlier

there are other exceptions as well

The focus various shareholders are placing on GOOG "patenting" an alleged workaround is an exercise in futility. They could be stealing someone else's solution/invention for all we know.

"Layman's Logic" rarely (if ever) applies to these situations.
