They're based in either Romania (according to My Web Of Trust) or in Costa Rica (according to WhoIs).
So... Yeah, they're out of jurisdiction. Also the SEC isn't a police force. They're not going to raid XUII, they're just going to halt their stock if they can reasonably connect them to APS.
And George Sharp isn't going to do a thing but gain a couple more fans. He can't sue them. Innocent until PROVEN guilty. So yeah, that's why it's "legal". It's not "technically" illegal unless you can prove ill intentions.
Cash positions are a noob's best friend. No one can protect you like yourself. The people getting burned on this are not going to see their entire account recovered. It's dead. APS ran off with the money and they're not returning it.
