I don't believe the Treasury has any say over the matter, and all I've read suggests it's a strategic business decision made by the GSEs at this stage.
On one hand Fannie has used all her DTAs, and will begin paying taxes agin. On the other hand Freddie is still deciding when to use his DTAs, and 100% profit will be swept in lieu of paying taxes.
IMO, the Treasury needs money and has zero motivation to insist DTAs not be used. Actually the motivation would be the opposite so if they had the authority to issue an order to do so, they would have insisted the DATs be used already.
