Pursuant to Local Rule 7-11, Plaintiff Bascom Research, LLC (“Bascom”) hereby respectively requests that the Court reinstate the dates previously set pursuant to Patent Local Rules 4-3 and 4-4 in this matter. The Court appears to have vacated those dates in response to a motion filed by defendants that was docketed and noticed as a regularly-noticed motion for which no response was due until August 15, 2013. Nonetheless, the Court issued its order granting the motion on August 7, more than a week before the date on which a response was due as indicated on the Court’s electronic docketing system. Bascom respectfully submits that the underlying motion was without merit and based upon incorrect statements of fact and incorrect conclusions of law. As such, Bascom opposes the underlying motion and hereby requests that the Court permit it to present its opposition, so that the Court may consider the matter fully on an appropriate record.
