What a terrible start for Goog to this whole Appeal thing. QE could have just mentioned about USPTO reexaminations in passing maybe in a line or two...but no..he had to make a BIG deal out of it..how great USPTO is..how well they look into the patents..how their word is the last and final yada yada yada :)). It came back to bite him BIG time now. If the appellate court agrees to what Vrng is saying, it's almost game over for Goog in the appellate court. Their case was already weak to begin with..it will be terribly weak now. But, IMO appellate court will allow Goog to file corrected brief. Hoping they don't do that.
