Goog/QE shot themselves in their foot. Liking it :). Just read cafc docket 47. That was a stupid move by QE bringing USPTOs 420 and 664 reexaminations in their initial brief when they knew 664 rejection was not final and 420 was still being worked on by uspto. Now that uspto confirmed 420 validity, it is going to be a pretty tricky/embarassing for QE. Appellate court may allow for a corrected brief but IMO damage is already done. QE was overconfident and his move backfired.
