I had to add to this post.

Large funds routinely lend their shares for a fee. Since we have small Tute ownership DG is on the right track with where the short inventory is coming from. I use TD Ameritrade and have a margin account. Under the new user agreement which they tend to revise every year, even though I am not on margin they can lend my shares. What ticks me off is that if they collect a fee on my asset I should be entitled to a portion of the proceeds. The only way I can stop them is by changing my account to cash only, which I don't feel like doing.

Naked shorting is only illegal if you have failed to cover your short after 3 business days, Remember a couple of years ago, we use to track the Regulation SHO share violation for APRI. I checked, no violations in a long time. You can see some of the funny business with a down 3 days in a row followed by a cover on 4 to stay clear of a Reg SHO violation.
