This topic will be covered in detail by posters in the coming weeks/months. Right now, everyone is focused on the pps spike that has nothing to do with this, so there is little discussion. However, the general form that this will take has already been revealed by GOOG's May filing where it tried to get HJJ to delay the RR ruling based on an already implemented workaround (so they say).

Google will file a motion saying they have a viable workaround designed and implemented as of x date. Thru HJJ, a time will be negotiated for VRNG's experts to review the new source code, and VRNG will then file their response saying that it is not colorfully different and that it still infringes. Presumably it will go back and forth a bit with further discoveries on both sides. In the end, HJJ will determine, without a jury, whether or not the workaround infringes or does not infringe the patents upheld in the original jury verdict.

Altho VRNG has the benefit of starting with a valid patent, they still must prove to HJJ thru their rebuttals of GOOG's briefs, that the new source code is not a viable workaround.......

As I said, this post Is almost off topic right now, considering where everyone's attention is focused! But you will have the benefit of seeing much more erudite posts on this topic in the near future.
