that's the intuitive way to think about it, and I'll let the legal eagles weigh in on this, but, since this is now entirely new code and valid by default (innocent until proven guilty), I'm pretty sure that VRNG has to prove infringement all over again on the new code..... Even if the words "colorfully different" are used, it is still not up to GOOG to prove "colorfully different, but rather up to VRNG to prove NOT colorfully different....
