The Clerk's Judgment filed on November 20, 2012 is the final, appealable judgment. It was entered pursuant to FRCP Rule 58 and approved by the Court. The appeal on that judgment can proceed, and is proceeding.

What I do not know is exactly how the Court's remaining rulings are handled once entered. Evidently the RR ruling is handled as a separate matter. No doubt that will be appealable after entry. I don't know how that's entitled as far as that Order itself. Is it the Court's Judgment, or some such name? I honestly don't know, but it will also be appealable after entry. I also don't know if that is handled as a totally, separate, appeal or if it later gets consolidated with the initial appeal from the judgment. Wish I knew that answer, but I don't so not much help there. Maybe someone else will chime in on it and educate all of us. If I had the time I'd find another patent case that went through trial and appeal and look at the PACER entries. Maybe I'll get a chance later in the week. I'd rather be spoon fed if someone else knows the answer. big smile
