... couldn't they still put the candidates through since they are the current board? The rogue whale investor doesn't have the power to block it right?

They could nominate them, but the "rogue investor"(s) (which I don't believe exist) appear to still wield the sword - per the agreement Johnny Boy has to vote the way they say and he has the majority so no others votes are necessary.
