I would think your recommendations would still be considered marketed as sublingual, but I am not positive on that. Can ritelin say "for best results crush up and take up the nose"?

I do know that Tuffin said they have been in talks with FDA and ensured that they are doing everything appropriately. I would guess that FUSE would want to advertise as sublingual since thats how the product appears to be intended. So my guess is the FDA told them not to do this.
