this is not a problem of communication by bank of ny

the 8-k in 2010 states that they did not think the guarantee
is /was enforceable

the only filed a claim as debt not equity

who is asserting and in what court our claim.

lehman vs barclay is arguing over cash / value
i do not see anything re cts payment or responsibility

this was a serious error by the trustee
