Injunctions Sought Against PEIX, Response Due Today...

PEIX had 21 days to hire their worthless lawyers. A response to the major lawsuit against them is due today.


Injunctions Are Coming, Lawsuit, Infringement!

"PEIX infringes and will continue to infringe one or more claims of the 858 patent.
PEIX's infringement has been willful, deliberate, and objectively reckless.
PEIX's infringing activities have injured and will continue to injure GERS until this court enters an injunction prohibiting furthur infringement.

GERS asks this court to enter judgement against PEIX.
For a preliminary injunction prohibiting furthur infringement of the 858 patent.
A permanent injunction prohibiting furthur infringment of the 858 patent.
An award of damages to compensate GERS for the infringement that's occurred."

Stay away from PEIX, they're being sued and losing for stealing patented technology...

GERS is seeking a preliminary and permanent injunction now that the courts have ruled against ICM. The preliminary injunction is based on the patents claims being interpreted in GERS' favor. ICM has filed for an appeal because they're losing.

"A preliminary injunction, in equity, is an injunction entered by a court prior to a final determination of the merits of a legal case, in order to restrain a party from going ahead with a course of conduct or compelling a party to continue with a course of conduct until the case has been decided. If the case is decided against the party that has been enjoined, then the injunction will usually be made permanent. "

In most courts in the United States, the party seeking the preliminary injunction must demonstrate all four things together:
1.That there is a substantial likelihood of success on the merits of the case,
2.That they face a substantial threat of irreparable damage or injury if the injunction is not granted,
3.That the balance of harms weighs in favor of the party seeking the preliminary injunction
4.That the grant of an injunction would serve the public interest.

The "balance of harms" refers to the threatened injury to the party seeking the preliminary injunction as compared to the harm that the other party may suffer from the injunction.


NK of PEIX Being Dishonest With Shareholders

There's officially a lawsuit filed against PEIX for stealing patented technology.
Yet NK puts out a PR bragging they're stealing. Does he think investors are stupid?

He did nothing to address shareholders concerns of how this major lawsuit will impact PEIX.
Injunctions are being sought against PEIX's illegal systems now in operation and he doesn't even mention that? This is material information investors deserve to know about. Why is he withholding the lawsuit news?

When does NK plan on telling shareholders PEIX is being sued?
Will he continue to pretend it isn't happening until injunctions hit?
If I wasn't here explaining all this, you guys would have no clue the road he's taking you down.
NK doesn't think you guys are smart enough to figure out he's walking shareholders into a litigation buzzsaw.

You guys/gals are being taken for a ride. The company that sold PEIX the equipment is already losing in court. Now PEIX is being sued directly as I predicted and as promised by GERS.

GERS invented and patented this industry changing process that ICM stole and sold to PEIX. ICM has lost every ruling in court. They're losing so badly, they filed for an appeal.

GERS has vowed to protect the competitive advantage that it's patented oil extraction gives to licensed producers like GPRE, SXL, BIOF, MPC and many more. In fact, Calgren (PEIX's partner) removed their infringing ICM equipment and licensed with GERS.

PEIX is stealing this patented oil extraction technology. The lawsuit now includes PEIX directly. NK needs to step down before shareholder value is completely destroyed.
