Actually, Barclays hold the assets along with certain liabilities (via the 365 BK liquidation) Now the major question is....did the bankruptcy court define, or would they define, Barclays as the "Successor"? Did Barclays buy all or substantially all of Lehman's assets under the 365 sale? We know of some assets in which Barclay's did not purchase....however could what Barclay's did acquire be considered substantially all? I believe so, maybe!
