I think Volk is trying to protect himself from that possibility in two ways.

The first is that new company he's got. If this one is taken over, he can transfer whatever assets to the new one and leave the shell behind. There don't seem to be any assets at the moment but some here think there are things in the works.

The second is the creation of those preferred shares. We don't know who holds those yet.

I don't bet but I wonder, what do you think Sutton would do with the shell if he got control?
