I don't think there is any reason why Radient would file bankruptcy. They cannot file a chapter 11 for lack of a lender so the option of the court converting to a chapter 7 will not happen.
However, there is the option of a creditor filing the chapter 7 for Radient in an attempt to get any remaining assets. The result of the class action lawsuit could end up with a chapter 7 to get assets.
One other item. If Mac is obligated to pay money as a result of the lawsuit, he CANNOT escape the obligation by filing personal bankruptcy. Debts due to crimminal acts cannot be discharged via a chapter 7 filing. IMO, Mac will lose his shirt on this one and any money from UNI will go to the lawyers defending Mac.
