I will give you the easy answer, cuz I am not a patent lawyer and cannot parse it in greater detail re patent #s and dates:

spoliation is NOT an issue (i.e., it is not a defense) as to JEDEC documents as regards DDR2 (b/c Rambus had left JEDEC and so could not have "deceived" JEDEC with respect to the DDR2 patents)

BUT

spoliation IS an issue (i.e., a defense) as to prior art documents as regards DDR2

I'm sure a bright guy like TAX could parse it out for you --- NOT
