= when Whyte REFUSED to give CE effect to Payne's statement from the bench in IFX, and REFUSED to dismiss the Rambus counterclaims against Hynix (4/05), that shows that Payne's order properly should not prevent the assertion of patent claims against a different mm
=Rambus was reasonable when it filed counterclaims in VA against Sammy

Rambus believes that
=if Payne will "take judicial notice" of Whyte's 4/05 decision it will bolster Rambus' claim to have acted reasonably and in good faith when it filed counterclaims in VA against Sammy, and
=Payne cannot find Rambus to have acted BASELESSLY when it filed counterclaims in VA against Sammy
