NDEP response.. for any that still care...

Sorry for the slow response but I have been out of the office for a large part of the last two weeks.

It is technically correct, but an application for a Permit modification for the concrete-lined ponds and additional de-sanding cyclones and screens has not yet been submitted and must await NDEP-BMRR approval before the initiation of construction.
