I sincerely hope you are wrong in your thought about HJJ ordering parties to negotiate. Court ordered settlement has about as much chance of succeeding as Israel and Hezbollah singing Kumbayah in the next 45 days........ I think it would be a complete waste of time.
VRNG and GOOG have had every chance to settle pretrial (court ordered negotiations with numerous carrots being offered to both sides), during trial, and now for the six months post verdict. There is NO indication on GOOG's part of wishing to settle. In their last brief, they hardly even acknowledged that a trial took place and relied on rejected arguments of lump sum negotiations between willing parties to try to minimize future payments. GOOG has no incentive to settle since:
1) the diff between 500mill and 1 billion is chump change to them.
2) They will insist they have a workaround and owe almost nothing.
3) They will appeal ANY RR be it 3.5 or 7.0% or more, basing their argument on the 2.6% base of the jury verdict.
And, I don't see VRNG being willing to settle for 3.5 million.
All that being said, who knows what HJJ will do. If he does require 45 day negotiation, it would obviate his previous "ripe for ruling" statement (IMO) and certainly would tank the pps...
