Situation in 2013:
Denner a small retailer sold in its stores Nespresso-Compatible cabsules. Nestle (bigger than Johnson and Johnson sued them, because Nestle sold the Nespresso Machine together with the Nespresso Capsules and told the retailer, you cannot sell – self created - Capsules that fit into this Nespresso machine under the brand Nespresso.
Nestle expects a verdict in the coming weeks, in a court case deciding whether Denner can sell generic Nespresso capsules without violating Nestle trademarks.

today May 21. 2014 the verdict came out: Nestle lost and Denner can now sell its capsules for Nespresso-Machines.
