No, I wouldn't call it a lie, especially without having access to the contract wording. Amarant obviously owed money and was behind on that payment, but that didn't mean the contract wasn't in full force and effect at that time. That didn't occur until Amarant was unable to remedy the Notice of Default by May 10.

While I'm not a contract lawyer by any stretch, there is plenty of support for this interpretation if you google various "Notice of Default" scenarios.
