If you had done your DD on the NOLs you would have found they can be bought, sold or transfered. The worst we can expect is that they are sold prior to exiting BK. In Solyndra case they formed a new company. They transfered the NOLs to the new company. They gave the Solyndra shareholders 100% of the new company. They kept 100% of the NOLs. The creditors have no claim on the NOLs thet belong to the shareholders.
