Read this essay and pay attention to page 1107 second paragraph. Particularly the last sentence in this paragraph. This thing could go either way, because the Baxter case seems to support a court ruling inspite of any USTPO patent Invalidation. So does anyone know if or if not a USTPO finding of "final patent invalidity" trumps a court ruling of patent infringement as ruled by a jury?
