In general penny stock scam participants when they run out of unsupported facts for rebuttal, they pull the cyber harassment law and threaten legal proceeding.(curious, that BH has not brought an action)

I've been on the internet stock game since 1998, and have witnessed ONE case of a penny stock CEO that won a small verbal "retraction". Michael Zwebner! I believe the SEC finally brought suit against Zwebner disposition of same escapes me. Google the name.
