The difference is that Apple didn't say it was available until it was available. Read the judgment against David Otto - it spells out why what they have been doing is illegal - here's an excerpt and the link to the whole case:

And Otto is the guy whose just-out-of-college employee is the VP of operations for KLDO, and whose office address is exactly the same - down to the suite number - as KLDO. And you're saying "no worries here"?
