Good points, good post. Between your post and mine, that covers both places the judge felt the patent was not exhausted.

Meanwhile, here is the Bio of the author of the article agreeing with the judge. He is based in San Fran, and has defended several large corps against anti-trust suits (in case you couldn't tell by the tone of the blog).
