When it comes to patent infringement trials, once a judgment of validity and past usage has been entered into the books, any defendant who continues to utilize the technology is willfully doing so.

EDIT: Let me also say some appellants have claimed that infringement is not willful until after all appellate rights have been exhausted... something the courts have shot down
