Using Max/Min Count filter with history

I want a window that shows a list of all stocks that have had a specific alert set throughout the day. I thought I could get this by setting Max Count in the window specific alerts to 1. But it looks like this is missing a lot of the stocks that should be showing up.

Why is the alert # greater than 1 when some stocks make their first high of the day?
