Bruce, speaking with legal education. Circuit city is the offeror and the buyer is the offeree. Now, if you had an xbox for sale could you make it a condition that you will only sale based upon satisfaction of that condition? The type of condition is referred to as a condition "preceedent" and once triggered the obligations of the parties can then be fullfilled. This is completely legal imo. If not, make sure you never buy a house with appliances, for they are factored into the market price and are also a condition preceedent.
