People keep saying the judge will be "pissed" for this reason or that reason as if the judge has some emotional tie to this case. This is the furthest thing from the truth. The judge does not care who wins this case only investors do. It is "my opinion" that the reason the judge threw out laches is because Vringo was not using the technology or patents prior to this trial so therefore no damages for past infringement. However, it has been determined by the USPTO that these patents are valid and furthermore determined by a jury in JJ's court that Google has and continues to infringe on these patents which are currently in the hands of Vringo. All of this leads to what I believe the final outcome of this trial will be, which is the Judge will award I/P Engine ongoing running royalties at a higher than awarded rate. This rate IMO will be somewhere in the range of 5-7% which Vringo asked for and will be deemed fair based on the revenue being generated by google for using these patents past and present. There is no question that Google as a company has prospered generously from the use of Lang's technology. There isn't much that can be done to repair the past but, as far as the future this Judge will do the right thing and appropriately compensate for the intellectual property presently owned and be taken advantage of by Google.
